Allahabad HC stays Yogi govt move to include 17 OBCs in SC List

up hc99Prayagraj, Sep 17: Allahabad High Court on Monday stayed the decision of the Yogi Adityanath government in Uttar Pradesh to include 17 Other Backward Castes (OBC) in the Scheduled Castes (SC) list.
The court’s decision came on a petition filed by social activist Gorakh Prasad.
A division bench, comprising Justices Sudhir Agarwal and Rajiv Mishra, stayed the government order of June 24 last which ordered to give 17 OBCs the SC facilities.
The court maintained that only Parliament can change the status and no government has such powers.
Apparently aimed at wooing the communities ahead of by-elections to 13 Assembly seats, the move came in June this year.
On June 24, the government had directed district magistrates and commissioners to issue caste certificates to 17 OBCs – Kashyap, Rajbhar, Dhivar, Bind, Kumhar, Kahar, Kewat, Nishad, Bhar, Mallah, Prajapati, Dhimar, Batham, Turha, Godia, Manjhi and Machua.
