EC cancels Anantnag LS bypoll

The Election Commission on Tuesday rescinded the by-elections in Anantnag parliamentary constituency in view of the prevailing law and order situation in Jammu and Kashmir and the Union Home Ministry’s inability to provide the requisite number of security forces for smooth conduct of the polls.

In its order, the EC said it had sought 687 companies of security personnel for the elections, based on the reports from the State police authorities. However, through a letter dated April 28, the Home Ministry expressed inability stating that only 250 companies could be provided to the State government.

The State Chief Secretary had, on April 20, informed the Commission that in the past few days, a large number of incidents of burning of schools, Panchayat properties – which were designated polling stations falling under the constituency. There were attacks on political personalities and reports of militants harassing the policemen and their families to generate an environment of insecurity, fear and chaos.

An apprehension was also expressed that the conduct of election in Anantnag on May 25 might witness large-scale violence, but can also result in an even lower voter turnout. Therefore, the State administration was of the view that the election be deferred at least up October end.

 The Commission also considered the option of further deferment of election as requested by some political parties and the State administration. In the context of requests for deferment, the Commission has taken note of the fact that the Holy month of Ramzan is fast approachoing which will be celebrated during the months of May and June.

The annual Amarnath Yatra is due to start in the last week of June till August and the State government would be busy making preparations for the celebrations. “Besides, this period is also important tourist season which affects the whole trade, business and commerce activities of the State,” said the EC order, observing that continuation of the Model Code of Conduct would adversely affect the daily lives.

Taking note of the facts, the EC said the by-election to the parliamentary constituency would now be held in due course when the situation becomes conducive to the holding of free, fair and peaceful election.
